前言
  2016年是“十三五”规划的开局之年，是全面建成小康社会决胜阶段的起始之年，也是供给侧结构性改革的攻坚之年，深入推进“四个全面”战略布局的重要一年。上海跨入深入推进中国（上海）自由贸易试验区建设和到2020年基本建成具有全球航运资源配置能力的国际航运中心的关键时期。随着“一带一路”、海洋强国等国家战略不断深化，海事审判在维护国家海洋权益和服务保障上海国际航运中心建设方面肩负更加重大的责任，必须进一步提高海事司法的战略定位和服务层级，进一步融入国家工作大局和上海经济社会发展进程。

面履行海事审判职能，以强化队伍建设为根本，以深化改革创新为驱动，不断加强海事审判专业化、信息化、现代化建设，全面提升海事司法公信力和国际影响力，审判执行和法院各项工作取得很大发展。为切实应对经济社会形势变化和国际航运市场下行压力，通过积极行使海事司法管辖权，依法妥善处理大量海事海商纠纷，平等保护中外当事人合法权益，切实维护我国海洋权益，为国家重大战略实施和航运经济发展提供了有力的司法保障。
  本通报反映了上海海事法院2016年依法履行海事审判职能，妥善审理和解决航运业及相关产业链上发生的案件纠纷的主要情况。同时通报了近年来审理涉船员权益保护相关案件的基本情况、工作经验和典型案例，以期为促进航运业持续健康发展、切实维护船员及其他航运主体的权益作出更大贡献。

  The year 2016 is the first year of the“13th Five-Year Plan”；it is the starting year of the d
ecisive period of completing the building of a moderately prosperous society in all respects.It is a vital year of structural reform on the supply side and an important year of pushing forward the Four-Pronged Comprehensive Strategy.It is a critical period of advancing in depth the construction of China（Shanghai）Free Trade Pilot Zone and turning Shanghai into an international shipping center capable of allocating global shipping resources by 2020.With the deepening implementation of state strategies of“One Belt，One Road”（OBOR）and maritime power，maritime trial is assuming greater responsibilities in safeguarding national maritime rights and interests as well as serving and guaranteeing the construction of Shanghai International Shipping Center.To this end，the strategic positioning and service level of maritime justice shall be enhanced，and the maritime justice must be integrated into national priority work and serve the economic and social development of Shanghai.
  In 2016，Shanghai Maritime Court，focusing on the priority tasks of the Party and the government，and adhering to the principles of people-orientation and impartiality，performed the functions of maritime trial in all respects.By intensifying the team constructi
on and promoting reform and innovation，Shanghai Maritime Court kept improving the professionalization，IT application and modernization of maritime trials to enhance the public credibility and international influence of maritime justice，and achieved significant development in many fields such as trial and enforcement.In order to tackle economic and social changes and downturn of international shipping services，Shanghai Maritime Court actively exercised the maritime judicial jurisdiction and properly handled a number of maritime disputes by law for equally protecting the legitimate rights and interests of Chinese and foreign parties and safeguarding China's maritime rights and interests，and provided effective judicial guarantees for the implementation of major national strategies and development of the shipping industry.
